All Sales Are Final

Receipt of payment implies agreement to all terms of sale. Damage/Condition of order issues upon receipt must be reported within 72 hours of receipt. No Damage/Condition issues will be considered after 72 hours.

Because we have no control of any element of a planting project from design to installation, we cannot offer any guarantees of plant survival. Please make sure you select plant material suitable for your project’s conditions and environment.

We are careful to keep varieties true to name, but mistakes sometimes happen. It is mutually agreed that our liability for any errors is confined to replacement with correct species or, if not available, credit of the purchase price.

In the event of an incorrect count we will send the missing items. There is no opportunity for a credit unless those items are not available. The credit will be for the missing amount only.

Buyer represents and agrees that any dispute arising out of the sale of these goods shall be arbitrated in the court system of Mathews County VA, and shall be the forum for any litigation that may arise from any sale of goods by the seller.

Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.

NO CLAIMS, FOR ANY REASON, WILL BE CONSIDERED AFTER 30 DAYS OF RECEIPT OF SHIPMENT.

Pricing
All pricing is subject to change without notice. We will not be responsible for errors in pricing for line items or calculation errors, communicated mistakes or listings.

Stock Type & Sizes
All stock is guaranteed to be true to name. "Grading" is not subject to opinion when dealing with a professional nursery.

Mid Atlantic Native Plant Farm Inc. grades according to USDA and ANLA standard. Bare root perennials are graded as #1 sized roots. All other bare root trees and shrubs are grade by ANLA sizing standards.

We grow many perennials, grasses and some shrubs in a square 50 cell sized plug. Our 50 cell square plug dimension are 1.93” x 1.93” top by 2.38” deep. Total soil volume of 5.8 cubic inches. By comparison our 50 cell plug soil volume is 30% larger than most competitor 72 cell sized plugs. We also grow some shrubs and trees in a 38 deep cell plug. The 38 deep cell plug dimensions are 2.25” diameter, by 5” deep with a soil volume of 12.10 cubic inches.

Digging and Shipping times
Weather depending bare root plant materials is dug and shipped late November - April 5th, while dormant, to minimize cycle interruptions due to shipping. Most plug tray grown species start shipping once fully rooted and transplantable starting Mid-May. Each species is different however and some may ship sooner or later.

We cannot guarantee ship dates but do our best to accommodate them.

Minimum Orders / Deposits
Minimum order is $150.00 (before tax, shipping & handling). THERE ARE NO EXCEPTIONS. Bare roots are dug to order, payment in full is required prior to scheduling your order for digging. As certain items sell out fast, and others are limited in their availability, please place your order as early as possible. All sales are final. Deposits are required to "hold" orders beyond 45 days and for contract grows.

Billing
Payment is required at order time. We DO NOT extend terms or credit.

Stock Availability
All pricing and availability are based upon our best estimates of future crops. We offer no guarantee or warranty that species will be available. Weather conditions, crop failures, seed failures, acts of nature, etc. are beyond our control. We do our best to inform all of our customers in the event shortages in availability of products.

Shipping & Handling
WE DO NOT GUARANTEE SHIP DATES.
Usually shipping rates are 20%-30% of the order total, with a $30.00 minimum within the IMMEDIATE mid Atlantic region. States outside the region will be assessed and additional %, as will large or heavy items and rural/job site deliveries. We do our best to recommend the best, quickest and most economical way to ship your order. We have independent haulers available for contracting hauling of larger sized orders. This INCLUDES ALL packaging, handling, and shipping costs.

Because of the type of packaging and custom-designed box style we use, shipping issues are rare. If there is a problem with your purchased items, it must be reported to us within 24 hours of receipt. Photos of the shipping materials and plants will be requested.

Claims resulting from carrier issues will result in your order being replaced or refunded once the claim is settled with the carrier.

Please report any other problems immediately, and we will make every effort to resolve any issues to your satisfaction. Under no circumstances will the claim amount exceed the order amount.

Cancellations
If an order is canceled after payment has been received, we reserve the right to charge a 25% re-stocking fee. Deposits on "special orders" are not refundable. Orders already DUG OR SHIPPED will not be refunded.

Inspections
Our nursery stock has been inspected by the Virginia Department of Agriculture. Your order will be shipped with a VA Nursery Inspection certificate.

Theft-

We have absolutely NO responsibility of any type for theft issues so long as the shipping address provided by the customer is the shipping address we ship to. In the event of theft of packages or plants delivered, we will assist the buyer with due process but it is the customer's responsibility in it's entirety to pursue any and all types of resolution on their behalf. So long as the delivery address and directions are entered as provided by the buyer, Mid Atlantic Natives liability is strictly and only limited to providing delivery details as reported by the delivery agent (e.i. UPS or a common freight carrier). It is the buyers' responsibility to file a police claim and provide a copy to Mid Atlantic Native Plant Farm Inc. to adhere to the shipper's claim process. We bare no responsibility to replace or refund purchased items for any reason so long as the ship to address is correct. We will not replace items without the full purchase price being reissued to Mid Atlantic Natives Inc. The resolution of this issue is solely the customer's, purchaser, ship to recipient or any person with in tended receipt of the purchase material.

Sales Tax
Mid Atlantic Native Plant Farm charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped. Virginia ship to addresses will be charged a 5.3% VA State Sales Tax.

Shipping

Our responsibility ends once the order leaves our facility.
